
The rule applies to landlords with six or more residential rental units in Maryland.
The offer must be included at lease signing for covered leases.
The written offer must include opt-in and opt-out instructions, plus a notice that opting out triggers a 6-month waiting period before re-enrollment.
Beyond the offer made at lease signing, covered landlords must make the reporting offer to tenants at least once annually thereafter.
For leases already in place before October 1, 2026, landlords must make the first offer no later than January 1, 2027.
If a tenant participates, landlords may charge no more than the lower of the actual cost or $10 per month. Consult legal counsel to confirm applicability.
